These Terms of Service ("Terms") govern your access to and use of the IFTA360 mobile application ("the App"). By using the App, you agree to these Terms, which form a legally binding agreement between you ("the User") and IFTA360 ("we", "our", or "the Company"). If you do not agree with these Terms, please refrain from using the App.
Eligibility: The App is intended for use by fleet owners, drivers, and businesses involved in managing IFTA (International Fuel Tax Agreement) tax reporting and fleet management. Business owners can purchase the App and assign it to their drivers. By using the App, you represent that you are either a business owner purchasing the App for your drivers or a driver using the App assigned by the business owner.
License: We grant you a non-transferable, non-exclusive, and revocable license to use the App for personal or commercial use, as long as you comply with these Terms.
Account Registration: To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during the registration process and maintain the security of your login credentials.
Compliance: You are responsible for ensuring that your use of the App complies with all applicable laws and regulations.

Data Integrity: You are responsible for entering accurate and complete data into the App. We cannot be held responsible for incorrect information provided by you.
Subscription Model: The App operates on a subscription-based model. Business owners are required to purchase licenses for their drivers.
Free Trial: A free trial period may be offered, after which a paid subscription is required to continue accessing the App's premium features.
Payments: Subscription payments are processed via Stripe, and all payment terms are governed by Stripe's policies.
Refund Policy: Payments for the subscription are non-refundable except where required by law.
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
No Warranty: The App is provided "as is." We do not guarantee that the App will be error-free or available at all times. We disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.
Liability: To the fullest extent permitted by law, IFTA360 will not be liable for any damages arising from your use or inability to use the App, including but not limited to direct, indirect, incidental, and consequential damages.
Termination by You: You can stop using the App at any time by uninstalling it from your device and deleting your account.
Termination by Us: We may suspend or terminate your access to the App if you violate these Terms or engage in any prohibited activities.
Effect of Termination: Upon termination, your access to the App will end immediately, and any outstanding payments will remain due.
Ownership: The App and all associated content (including text, images, software, and trademarks) are owned by IFTA360 and are protected by copyright, trademark, and other intellectual property laws.
License Restrictions: You may not copy, distribute, modify, or create derivative works based on the App without our prior written consent.
Governing Law: These Terms are governed by the laws of the State of Texas, USA.
Dispute Resolution: Any disputes related to these Terms shall be resolved through binding arbitration in Austin, Texas, under the rules of the American Arbitration Association.
We may update these Terms from time to time. If any material changes are made, we will notify you via the App or email. By continuing to use the App after such changes, you accept the modified Terms.
